By registering for any course, service, or program with Certification Academy, you acknowledge that you have read, understood, and agree to be bound by these policies and agreements in their entirety.

3. Course Registration and Enrollment
3.1 Registration Requirements
Course registration is complete only when:
- Full payment has been received and processed
- All required enrollment information has been provided
- Course capacity is available
- Any prerequisite requirements are met
- These terms and conditions are accepted
3.2 Course Confirmation and Materials
Upon successful registration, you will receive:

3.3 Enrollment Changes and Transfers

4. Payment Terms and Billing

4.2 Corporate and Group Enrollments

4.3 Failed Payments and Collection
If payment is declined or fails:
- Your enrollment may be temporarily suspended
- You are responsible for any bank fees or charges
- Collection actions may be initiated for unpaid balances

5. Cancellation, Refund, and Transfer Policies
5.1 Cancellation and Refund Policy
24-Hour Guarantee: All purchases are fully refundable within 24 hours of payment, no questions asked.
After 24 Hours: All sales are final. No refunds will be provided except as specifically outlined in our Pass Guarantee Policy (Section 6).
Written Request Required: All cancellation requests must be submitted in writing via email to [email protected] and include:
- Full name and registration details
- Course name and scheduled date
- Reason for cancellation request
- Preferred method of refund (if applicable)
5.2 Course Transfer Policy
Initial Transfer: If you cannot attend your registered course, you may request ONE transfer to a future date if:
- Your written request is received at least ten (10) business days before your original course start date
- Space is available in the requested future course
- The new course date falls within 6 months of your original purchase
Transfer Limitations:
- Only one transfer is permitted per enrollment
- Transfers are subject to availability and cannot be guaranteed
- Once you transfer to a new date, your enrollment becomes completely non-refundable
- Transfers to premium courses may require additional payment for price differences
- No transfers are permitted within 10 business days of the original course start date
5.3 Non-Attendance Policy
No-Show Consequences: Failure to attend your registered course (original or transferred date) results in:
- Complete forfeiture of all fees paid
- No refund eligibility under any circumstances
- Loss of all course materials and access
- No transfer options to future dates
5.4 Course Rescheduling by Certification Academy
If we must reschedule a course due to:
- Instructor unavailability
- Insufficient enrollment
- Technical difficulties
- Venue issues
- Public emergencies or force majeure events
We will provide:
- At least 48 hours advance notice (when possible)
- Alternative dates within a reasonable timeframe
- Option to attend a comparable live virtual session
- Full refund if no suitable alternative is acceptable to you
We will NOT provide refunds when suitable alternatives are offered and declined.
6. Pass Guarantee Policy
6.1 Pass Guarantee Eligibility
Our industry-leading Pass Guarantee demonstrates confidence in our training quality. To qualify for a full refund under this guarantee, you must meet ALL of the following requirements:
a. Complete Attendance: You must attend and actively participate in the entire scheduled course, including all sessions, labs, and activities.
b. Exam Documentation: You must provide official post-exam assessment reports from the certifying body within ten (10) business days after each failed exam attempt.
c. Three-Attempt Rule: If you fail the certification exam three (3) consecutive times within 120 calendar days of completing our course, you qualify for the pass guarantee refund.
d. Good Faith Effort: You must demonstrate serious preparation and good faith effort in your exam attempts.
6.2 Pass Guarantee Process
Documentation Required:
- Official exam failure notices from the certifying body
- Score reports showing specific areas of deficiency
- Proof of exam dates within the 120-day window
- Any additional documentation requested by Certification Academy
Refund Process:
- Refunds are processed within 30 days of receiving complete documentation
- Refunds are issued via check to your billing address
- Refund amount will not exceed the actual course tuition paid
- Processing fees, materials costs, and third-party charges are non-refundable
6.3 Pass Guarantee Exclusions
The Pass Guarantee does not apply if:
- You do not attend the complete course
- You fail to provide required documentation within specified timeframes
- Exam failures occur beyond the 120-day window
- You violate any course policies or engage in academic misconduct
- You attend a discounted, promotional, or complimentary course
7. Student Responsibilities and Code of Conduct
7.1 Professional Conduct
Students are expected to:
- Maintain professional behavior during all course sessions
- Respect instructors and fellow students
- Arrive on time and prepared for each session
- Participate actively in course activities and discussions
- Follow all course guidelines and instructions
7.2 Technology and Equipment
Students are responsible for:
- Having reliable internet connection for virtual courses
- Using compatible devices and software
- Testing technical requirements before course start
- Having backup plans for technical difficulties
- Contacting support promptly if technical issues arise
7.3 Academic Integrity
Students must:
- Complete all assignments and assessments independently (unless group work is specified)
- Not share course materials, recordings, or content with unauthorized parties
- Respect intellectual property rights of all materials
- Report any suspected violations of academic integrity
7.4 Disruptive Behavior Policy

Removal Consequences:
- Immediate loss of access to course and materials
- No refund of any fees paid

8. Course Delivery and Service Standards

A service is considered fully delivered when:
- Access instructions and course materials are provided to the registered student
- Course seat is reserved and confirmed
- Instructor and venue arrangements are secured
- Virtual access credentials are distributed (for online courses)
- Rescheduling options are confirmed in writing (when applicable)
This policy protects against unsubstantiated “service not received” claims when Certification Academy has fulfilled its obligations to provide course access.
8.2 Course Quality Standards
We maintain high-quality educational standards through:

- Current, relevant course materials

- Comprehensive support resources
- Continuous curriculum updates

8.3 Technical Support and Assistance
We provide technical support for:
- Course access and login issues

9. Intellectual Property and Copyright

- Provided under limited personal use license only
- Not to be reproduced, distributed, or shared without written authorization

9.3 Prohibited Use
You may NOT:

- Immediate termination of access and services

10. Payment Disputes and Protection
10.1 Dispute Resolution Requirement
Before initiating any payment dispute, chargeback, or claim with your financial institution, you MUST:

- Provide detailed explanation of your concern or dispute
- Allow 5 business days for our response and resolution attempt
- Exhaust all internal resolution procedures
10.2 Chargeback Prevention and Consequences
By registering for any course, you acknowledge that:
- Certification Academy incurs immediate, real costs upon your registration (instructor time, materials, venue reservations, administrative processing)
- Services are considered delivered once access is provided or seats are reserved
- Failure to attend does not constitute grounds for payment reversal
- Chargebacks initiated without following proper dispute procedures constitute a violation of this agreement
10.3 Chargeback Violation Penalties
Unauthorized chargebacks may result in:
- Immediate forfeiture of all current and future services
- Removal from all active courses with no refund
- Collection actions for disputed amounts plus additional fees
- Administrative penalty fees of up to $500 per unauthorized chargeback
- Legal action for damages, attorney fees, and court costs
- Permanent restriction from future enrollment
10.4 Legitimate Dispute Resolution
We are committed to resolving legitimate concerns fairly and promptly. If you have a genuine issue with our services, please contact us first. Most issues can be resolved quickly through direct communication.
11. Disclaimers and Limitations
11.1 Service Availability
While we strive for excellence, Certification Academy does not guarantee:
- Uninterrupted access to online platforms or materials
- Error-free delivery of all services
- Compatibility with all devices or internet connections
- Availability of specific course dates or locations
11.2 Certification and Exam Eligibility
We do not guarantee:
- Your eligibility to sit for any certification exam
- Successful passage of any certification exam
- Acceptance of your application by certifying bodies
- Recognition of certifications by employers or industry organizations
Important Note: Exam eligibility and requirements are determined solely by the relevant certifying bodies, not by Certification Academy.
11.3 Employment and Career Outcomes
Certification Academy does not guarantee:
- Employment opportunities or job placement
- Salary increases or career advancement
- Specific return on investment from training
- Professional success or career outcomes
11.4 Force Majeure
We are not liable for delays or cancellations caused by circumstances beyond our reasonable control, including but not limited to:
- Natural disasters, pandemics, or public health emergencies
- Government regulations or travel restrictions
- Strikes, labor disputes, or supply chain disruptions
- Technical failures of third-party service providers
- Instructor illness or emergency situations
12. Limitation of Liability
12.1 Liability Limits
Maximum Liability: In no event shall Certification Academy’s total liability to you exceed the amount you actually paid for the specific course or service in question.
Excluded Damages: Under no circumstances shall we be liable for:
- Indirect, special, punitive, incidental, or consequential damages
- Lost profits, revenues, or business opportunities
- Loss of use, data, or expected savings
- Cost of substitute goods or services
- Personal injury or property damage (except where prohibited by law)
12.2 Basis of Liability
These limitations apply regardless of the legal theory of recovery, whether based on:
- Contract, warranty, or agreement
- Negligence or other tort
- Strict liability
- Statutory claims
- Any other legal or equitable theory
12.3 Jurisdictional Variations
In jurisdictions that do not allow certain limitation or exclusions of liability, our liability shall be limited to the maximum extent permitted by applicable law.
13. Governing Law and Dispute Resolution
13.1 Governing Law
This Agreement and all related disputes are governed exclusively by the laws of the State of Arizona, without regard to conflict of law principles. The Arizona state and federal courts shall have exclusive jurisdiction over any legal proceedings.
13.2 Mandatory Arbitration
IMPORTANT: By enrolling in any course, you agree that any dispute, claim, or controversy relating to your enrollment, payments, services, or this agreement will be resolved through binding arbitration rather than in court.
Arbitration Rules:
- Conducted under the Commercial Arbitration Rules of the American Arbitration Association
- Administered by a single arbitrator in Arizona
- Discovery limited to what is reasonably necessary
- No class actions or representative proceedings permitted
- Arbitrator’s decision is final and binding
13.3 Exceptions to Arbitration
The following matters are excluded from arbitration and may be pursued in court:
- Claims for injunctive relief to protect intellectual property
- Small claims court actions (under $10,000)
- Collection actions for undisputed amounts owed
13.4 Waiver of Jury Trial
YOU WAIVE YOUR RIGHT TO A JURY TRIAL. This waiver applies to all claims and disputes covered by this agreement.
14. General Provisions
14.1 Entire Agreement
These policies, together with your enrollment agreement, constitute the complete agreement between you and Certification Academy and supersede all prior agreements, representations, or understandings.
14.2 Modifications
We reserve the right to modify these policies at any time. Changes will be effective immediately upon posting to our website. Your continued use of our services constitutes acceptance of any modifications.
14.3 Severability
If any provision of this agreement is found to be invalid or unenforceable, the remaining provisions will remain in full force and effect.
